1. Scope
1.1 These General Terms and Conditions (“GTC”) apply to the use of the website www.flon-records.ch (the “Website”) and to all product orders placed through the Website’s online shop in Switzerland, in the version valid at the time of each order.
The Website is owned and operated by Flon Records, Avenue de Jurigoz 2, 1006 Lausanne, Switzerland. Contracts for online purchases are concluded between the customer (“Customer”, “you”) and Flon Records (“we”, “us”).
1.2 We reserve the right to amend or supplement these GTC at any time at our discretion. The applicable version is the one in effect at the time the order is placed.
1.3 Any deviating, additional, or conflicting terms and conditions of the Customer shall not apply unless expressly agreed to in writing by us.
2. Terms of Use
We are committed to serving our customers with the utmost care and providing high-quality products. Flon Records offers both brand-new and pre-owned items, as clearly indicated in each product description. It is the Customer’s responsibility to verify whether an item is new or second-hand. All second-hand items are in full working condition, and their grading is provided in the description.
2.1 Proper registration is required to use the online shop. Customers are responsible for providing accurate and complete information.
2.2 We are under no obligation to accept a registration or an order, nor to make the Website and its services permanently available. Confirmed orders already accepted remain unaffected.
2.3 A contract between the Customer and Flon Records is concluded when the Customer places an order via our online shop or by email. Upon receipt, Flon Records will send an automatically generated order confirmation. This confirmation merely acknowledges receipt of the order and does not guarantee product availability or delivery. If an order cannot be fulfilled, the Customer will be refunded.
3. Subject Matter of the Contract & Product Characteristics
3.1 The contract covers the products specified in your order and confirmed in your order confirmation, at the retail prices listed in the online shop. Errors and omissions are excepted, particularly regarding availability; however, we strive to correct such errors promptly.
3.2 Product characteristics are based on the descriptions provided in the online shop. Product images may differ from the actual items—especially in color—due to technical factors. Images are for illustration purposes only. Conditions of pre-owned products are described as accurately as possible but may show normal variations.
3.3 The product listings on the Website constitute a non-binding online catalog and do not represent a legally binding offer.
4. Shipping
Orders are typically shipped within two (2) business days via Swiss Post. Shipping costs are calculated at checkout based on weight and destination.
We ship worldwide, but Flon Records is not responsible for customs duties or local fees at the destination.
If a delivery delay occurs (e.g., due to temporary unavailability), we will inform the Customer immediately.
The Customer is obliged to accept delivered goods.
5. Returns
Defective or damaged items must be reported within 48 hours of receipt. Customers must return the defective product within 5 days, including a description of the issue, customer number, and invoice number. After inspection, we will either send a replacement or issue a credit if the item is no longer available.
Returns for other reasons are only accepted with prior agreement from Flon Records

Items must be returned via postal service. Postage costs will be refunded only if the product was delivered incorrectly or is defective.

6. Warranty / Liability
Liability for supplied goods is limited to replacement delivery. Claims for contract rescission or price reduction will not be accepted if a replacement can be provided within a reasonable timeframe.
Complaints about product defects must be made within 48 hours of receipt. If the inspection reveals the defect is due to customer negligence (e.g., improper handling), the Customer will bear the replacement cost.
Our liability, including that of our representatives or agents, is limited to intent and gross negligence. This limitation does not apply in cases involving essential contractual obligations or warranted characteristics.
7. Place of Jurisdiction
All business activities are governed exclusively by Swiss law. The place of jurisdiction is Lausanne (Vaud), Switzerland.

9. Severability
